Will Nintendo Sue? Department of Homeland Security Uses Pokémon Theme Song While Arresting People

The United States Department of Homeland Security recently posted a video on their official X handle with Pokémon’s theme music as the background. The video shows ICE raids and people getting arrested, with glimpses of Ash Ketchum from the Pokémon series.

This video has the entire Pokémon fandom enraged, and they’re calling for Nintendo to take legal action. Nintendo is known for taking its intellectual property seriously and has even released a statement over this entire ordeal. Can we expect them to sue DHS in the near future? 

The Repercussions of Legal Action Might Be Too Severe for Nintendo 





The video posted on the DHS X handle is a serious national issue. The addition of Pokémon music to raids is a diabolical move, especially coming from the government itself. It trivializes the severity of events. Pokémon getting caught up in this political tussle is shocking, but the company was quick to respond to the ordeal. 

The Pokémon Company International has already issued a statement, via Polygon, and confirmed that they were not involved in the creation or circulation of the video in any way. 

We are aware of a recent video posted by the Department of Homeland Security that includes imagery and language associated with our brand. Our company was not involved in the creation or distribution of this content, and permission was not granted for the use of our intellectual property.

With this statement, The Pokémon Company has clarified its stance. Legal action would put out a more stern message. However, taking legal action against the US Government won’t bode well for Nintendo. It’s a risky move, since it’s more than a simple legal conflict between media conglomerates. 

By suing the DHS, Nintendo would be picking a bone with the US Government and President Donald Trump himself. It’s extremely risky and might turn into a national issue fairly quickly.

Fans Are Appalled At the Inaction on Nintendo’s Part 

Pokémon is wildly popular around the world. From the plushies and other merchandise to the games and anime series, the franchise has a strong hold on its fanbase. The fandom isn’t happy with how their beloved franchise has been caught up in matters of national importance. 

Some fans are asking Nintendo to sue the DHS, while others are delving into the message behind the video. 

Some fans have rightfully pointed out the technicalities involved in legal action, and the sheer time and monetary resources it takes. There’s also a due course of action that needs to be taken if Nintendo or The Pokémon Company decides to take the legal route.
